GOOD SAMARITAN SEXUALLY ASSAULTED IN HER HOME
A WOMAN was sexually assaulted by a 35-year-old man in Kirkcaldy after allowing him into her home.
He had been put out in the cold overnight by his partner and the victim had acted as a Good Samaritan when she found him shivering in his car.
However, Adrian Kolczak took advantage of the situation and sexually assaulted the woman.
She fought back punching him until he stopped.
Kolczak, of Church Street, Kirkcaldy, appeared in the dock at the town’s sheriff court accompanied by a translator.
He admitted that on 28th March 2023 at another address in Kirkcaldy he sexually assaulted a woman by standing over her, putting his hand under her pyjama top and seizing her breasts.
He pulled her top down exposing her breasts, kissed her stomach, pulled her pyjama trousers down and repeatedly kissed her pubic area.
Depute fiscal Rachel Hill said the victim lived at that time near to Kolckak’s then partner but did not know either of them well.
At around 2am the woman heard a noise from outside and saw Kolckak in the street.
She went outside to speak to him and found he was intoxicated.
He told her he had been “kicked out” and he was going to spend the night in his car.
The woman made him a coffee in her home and he left with it.
At 3.50am the woman went back outside to the car to check on Kolczak and found he was “shivering with the cold”.
She invited him into her home to “warm up” but he initially declined the offer.
However, at 4.55am the woman heard Kolczak shouting and banging on his partner’s door.
The victim went back outside and again told him he could come out of the cold and this time he went into her home.
She pointed him to a sofa but Kolczak said, “Are we going to bed?”
“She felt uncomfortable and felt she could not trust him to stay out of her bedroom if she went there,” added the depute.
The woman decided she would stay awake in the living room but Kolczak began making inappropriate comments about her being “beautiful” and asking why she was not in a relationship.
At 7am the woman heard her son’s alarm going off for him to get ready for school.
At 7.30am the woman had closed her eyes briefly and when she opened them again Kolczak was standing over her and grabbed her pyjama top, exposing her breasts.
She struggled with him and he pulled down her pyjama bottoms. He began kissing her on the stomach then on her naked private parts.
The woman then punched him repeatedly to get him off her and said to him “How f****** dare you. That’s sexual assault.”
Kolczak then apologized and tried to shake the woman’s hand.
The incident was left victim “feeling stupid for letting him into her home but also violated and disgusted” added the depute.
Sheriff Robert More called for reports and Kolczak will return to court for sentencing on 12th May. He has been put on the sex offenders register.
