NO JAIL FOR SEXUALLY ASSAULTING GIRL (8) WALKING TO SCHOOL

An eight-year-old girl was sexually assaulted as she walked to school with her brother.

Her attacker has walked free from court.

She was targeted by Kai Groborz as she walked along a lane in Halbeath, in a shocking incident.

In a separate offence, he had been caught with a hoard of indecent images of children and bestiality.

However, 18-year-old jail Groborz, of Seamark Place, Ballingry, avoided a custodial sentence when he appeared in the dock at Kirkcaldy Sheriff Court.

He previously admitted that between 23rd May 2022 and 22nd August 2023 at Riccarton, East Kilbride and elsewhere, he downloaded indecent photographs of children.

On 12th October 2022, at the same address he distributed obscene material, namely an image of a child engaged in sexual activity with an animal.

Groborz further admitted that on 19th January last year, in a lane between Fod Street and Fleet Street, Halbeath, he sexually assaulted a girl then aged eight years by touching her private parts over her clothing with his hand.

Depute fiscal Sarah Smith said that at the time of the Halbeath incident, Groborz was living in that area with his gran and uncle.

The young girl was walking to primary school with her brother, leaving their home at 8.40am and heading along a footpath.

The girl was walking several steps behind her brother when Groborz approached her and touched her.

The girl shouted to her brother and Groborz ran off. She told her brother what had happened and he reported the matter to their headteacher.

He said, “My sister was touched by a paedophile on the way to the school.” The girl then told the teacher what had been done to her and the police were contacted.

When police went to Groborz’s home at 4.15pm that day to speak to him and said, “I know what it’s about” and was arrested.

Sheriff James Williamson said of the offences, “There are elements that are sinister.”

He imposed a community payback order with three years of supervision and participation in a sex offenders programme.

The sheriff told Groborz that “but for your age you would have faced a custodial sentence.”

He added, “What’s of paramount importance is that there is no further offending.”

Groborz was ordered to stay away from places used by children, such as play parks and schools.
